Sharing the Federal Court’s settlement offer from an IRCC representative , received for our client for unreasonable LMIA Work Permit Rejection. The client had an initial rejection and came to us for his new application. We saw few issues in the previous application and decided to submit a new application with strong legal arguments based on decided case laws. However, the officer did not take anything into consideration and refused the application on different grounds. We challenged the refusal in the Federal Court and received the offer to settle. We are excited to share that our client has got approval for an LMIA work permit on the basis of the strong legal submissions made after the settlement offer received on the fling of Judicial review.
Our client applied for an LMIA work permit twice; initially in April 2024 which was rejected by the IRCC in June 2024 and then he applied again in December 2024 which was refused in March 2025. We filed a Judicial review challenging the decision of the visa officer before the Federal Court. The opposite counsel gave a settlement to our client for getting the application redetermined by a different IRCC officer. The client accepted the offer and got an opportunity to submit additional documents. We submitted the documents along with strong legal submissions and finally our client got his LMIA work permit visa approved in December 2025.

We challenged the decision of the visa officer before the Honorable Federal Court with strong legal submissions on February 18, 2026. We received a settlement within 10 days from the IRCC and our client was provided with the opportunity to submit additional documents in the LMIA Work Permit Application. The counsel from IRCC agreed that the decision of the IRCC officer is unreasonable and agreed to get it reassessed by the Different Officer with the chance to provide updated documents.
